We have provided expert witnesstestimony involving benefit matters in a range of settings, for multiple employers. Examples include:
United States Postal Service, before the Presidential Commission on the United States Postal Service in 2003, and in arbitration proceedings involving the National Rural Letter Carriers’ Association, the National Association of Letter Carriers, the National Postal Mail Handlers Union, and the American Postal Workers Union and other unions between 1991 and 2020. We have also appeared to provide expert witness testimony before fact-finding panels associated with the consultation process required in proceedings involving USPS and management associations representing certain classes of management personnel, such as Postmasters and Postal Supervisors.
Washington Metropolitan Area Transit Authority, before the arbitration panel in 2005 addressing health benefit issues for the transit system’s police officers, and in 2009 and 2018 Interest Arbitrations with Local 689 of the Amalgamated Transit Union, and in 2010 with Local 2 of the Office and Professional Employees International Union
Amtrak, before the Zumas arbitration panel in 1990and in the arbitration with the Passenger Rail Labor Bargaining Coalition in 2014. We have also appeared in proceedings before Presidential Emergency Boards as provided for under the Railway Labor Act to assist in resolving labor disputes involving the nation’s transportation infrastructure.
We have provided Compensation and Executive Compensation testimony services in litigation matters including:
the reasonableness of compensation
a contract dispute involving compensation in front of the General Services Administration Board of Contract Appeals,
a matter supporting claims of plaintiffs, settled in favor of plaintiffs, as minority shareholders contending oppression by majority shareholders, and excessive executive compensation of majority shareholder defendants, and
a matter representing retired executives settled in arbitration in favor of the retired executives which compelled an organization’s Board of Directors to honor prior commitments to pay retired executives compensation that had been deferred.
